What Is Physician Peer Review?
Physician peer review is a formal process used by hospitals and healthcare organizations to evaluate the clinical care, conduct, and competency of physicians who hold medical staff privileges at the institution. The peer review process is governed by hospital bylaws, the Health Care Quality Improvement Act (HCQIA), and state law.
While peer review is intended to ensure patient safety and quality of care, it can also be abused — used as a tool to eliminate competition, retaliate against physicians who have raised safety concerns, or target physicians for discriminatory or politically motivated reasons.
What Is an NPDB Report?
The National Practitioner Data Bank (NPDB) is a federal electronic repository created by Congress to improve healthcare quality and reduce healthcare fraud and abuse. Hospitals and other healthcare entities are required by federal law to report: Clinical privilege actions taken against physicians for reasons related to professional competence or conduct. Certain malpractice payments made on behalf of licensed healthcare practitioners. Medicare and Medicaid exclusion actions.
An NPDB report is one of the most damaging events in a physician's career. It follows the physician for life and must be disclosed in credentialing applications at every future employer, hospital, and healthcare facility.
What Are Medical Staff Privileges?
Medical staff privileges are the specific clinical activities — procedures, diagnoses, treatments — that a hospital or healthcare facility authorizes a physician to perform at that institution. Privileges are granted through the credentialing process and can be suspended, restricted, or revoked through the peer review process.
What Are a Physician's Rights in the Peer Review Process?
Under the Health Care Quality Improvement Act (HCQIA), physicians are entitled to notice of the action being taken, a hearing before a peer review committee, representation by counsel in certain circumstances, an appeal process, and a written decision explaining the basis for the action.
