What Is Physician Peer Review?
Physician peer review is a process used by hospitals and healthcare organizations to evaluate the quality and appropriateness of medical care provided by physicians. While peer review is designed to ensure patient safety and quality of care, it can also be weaponized — used against physicians for anti-competitive, retaliatory, or politically motivated reasons.
When a peer review process results in adverse action, the consequences for a physician can be devastating: suspension or revocation of medical staff privileges, mandatory reporting to the National Practitioner Data Bank (NPDB), and potentially permanent damage to a medical career.
What Is an NPDB Report?
The National Practitioner Data Bank (NPDB) is a federal database maintained by the U.S. Department of Health and Human Services. Adverse actions against physicians — including peer review actions resulting in suspension or restriction of clinical privileges for more than 30 days — must be reported to the NPDB. An NPDB report follows a physician for the rest of their career and can affect credentialing, licensing, and hospital privileges nationwide.
Medical Staff Privileges and Why They Matter
Medical staff privileges grant a physician the right to practice medicine at a hospital or healthcare facility. Hospitals have significant discretion in granting, restricting, suspending, or revoking privileges. However, that discretion is not unlimited. When a hospital acts arbitrarily, discriminatorily, or in bad faith, legal remedies may be available.
