Like a marital divorce, a business divorce involves dividing assets, allocating liabilities, negotiating buyouts, and often involves disputes about the valuation of the business. Business divorces can be accomplished through negotiated settlement, mediation, or court proceedings.

What Is Breach of Fiduciary Duty in Business?

Breach of fiduciary duty occurs when a person who owes a duty of loyalty, care, and good faith to a business or its co-owners violates that duty through self-dealing, fraud, misappropriation of assets, or other conduct that harms the business or its owners. Common fiduciaries in business include partners, LLC managers and members, corporate officers and directors, and controlling shareholders.
